Solicitor to investigate allegation e-mail list was misused

NORTH KINGSTOWN - The Police Department is investigating allegations that private e-mail addresses given to the School Department were used to disseminate a local group's views on the upcoming School Committee election.
Police Chief Edward Charboneau confirmed that the
department was investigating the complaint, but said he was doubtful that any
criminal charges would be filed.
"I have forwarded that complaint to our Town Solicitor for further
review," he said. "A group mailing list was [used] from the high
school, but no one ever hacked into the high school computer."
Acting Superintendent Dr. Phil Thornton said that he has personally received
about 20 complaints over the last two weeks from parents of students who were
upset about two e-mails that were sent by Greg O'Neill and the Concerned
Citizens of North Kingstown, a local parent group.
"The bottom line is that we're responding to complaints that some of our
parents are being sent political messages to private e-mail addresses that they
provided to the School Department, and now we're just doing our due
diligence," Thornton said.
The e-mails in question endorsed School Committee candidates Ralph Balsamo,
Lance Chappell and Richard Welch and opposed Lynda Avanzato and Melvoid Benson
and gave explanations as to their decisions.
"We're puzzled because we've been using this same [e-mail] list for the
past 18 months, and now we're getting these complaints," said O'Neill,
referring to e-mails he sent out supporting last year's failed school bond.
"We're just exercising our Constitutional right to spread our views on the
candidates for School Committee."
He said that the e-mail list was compiled by gathering addresses from school
directories that are sent home with students, as well as lists from several
different groups in town and addresses that were gathered from forwarded e-mails
over the last year and a half.
"In this town, you can send an e-mail to somebody and, within 24 hours, it
can get sent around to the whole town," O'Neill said.
After the first CCNK e-mail was sent out, Thornton used the high school listserv
to contact parents regarding the e-mail.
"I wanted to take this opportunity to clearly state that the North
Kingstown School District is non-political and we do not support candidates for
School Committee or other town offices," Thornton wrote. "The e-mail
sent a few days back to many individuals on our list server was in no way a
product of the school district."
After Thornton's e-mail was sent, the same CCNK e-mail was distributed again,
and that is when the police department became involved.
This is not the first time that allegations of abusing the School Department's
listserv have been made.
During the 2006 election, former superintendent James Halley accused former
School Committee member Bill Mudge of inappropriately using his position as a
board member to distribute information regarding the election after sending a
link to his personal Web site. It was also brought up in 2004, after Mudge sent
e-mails rebutting a letter to the editor published in the local newspapers.
The matter was taken to court, but Mudge, who was represented by Avanzato and
her husband, eventually abandoned his court case because he felt it was wasting
valuable education dollars.
*NKSPENDING Editor Note: The last section of that article clarification. There was no list serv address book usage WHATSOEVER by Mudge in 2006. Bill Mudge was criticized for SENDING email TO everyone in his own address book, which included whomever in the school department he happened to have the address for. This was an email from the outside, from his own pc, to his own email addressees given to him freely by each person. Bill Mudge NEVER had "his own personal web site". He simply send out an email as a candidate for office to everyone who had previously given him their email address. Perfectly legal, legitimate, and well protected by the first amendment free speech rights we all have. He simply sent an email.
The CCNK was INVESTIGATED for apparently sending emails to email addresses they were not given by the parents directly, but rather, our superintendent received MANY complaints that many of those emails were ONLY given to the school department and should not have fallen into the hands of the Halloran, O'Neill, Dewhurst, Dion group of nk republicans.
FREE SPEECH for ALL (Even the CCNK?) YES! Pilfered email addresses, false messages, and baseless attacks? NO!
